Radio Frequency Resource

The Law of Ukraine “On Radio Frequency Resource of Ukraine” defines legal basis for use of radio frequency resource of Ukraine, determines of state powers on terms and conditions of use of radio frequency resource of Ukraine, rights, obligations and responsibilities of public authorities that conduct management and regulation in this area as well as of natural and legal persons that use and/or intend to use radio frequency resource of Ukraine.

The National Commission for Communications Regulation of Ukraine (NCCR) is the regulatory authority in the area of use of radio frequency resource of Ukraine that is established according to the Law of Ukraine “On Telecommunications”.

Powers of the NCCR on regulation in the area of use of radio frequency resource of Ukraine:

1. The NCCR exercises its powers within public radio frequency bandwidths.
2. Powers of the NCCR on regulation in the area of use of radio frequency resource of Ukraine are the following:
   1. licensing in the area of use of radio frequency resource of Ukraine according to the Law “On Radio Frequency Resource of Ukraine”;
   2. elaboration and approval of legislative and regulatory acts (rules, provisions, regulations) on regulation in the area of use of radio frequency resource of Ukraine;
   3. submitting proposals to the Central Executive Authority in the communications area and participation in elaboration of the National Table of Allocation of Radio Frequency Bandwidths of Ukraine as well the Plan for Use of Radio Frequency Resource of Ukraine in accordance with requirements of this Law;
   4. coordination of the draft National Table of Allocation of Radio Frequency Bandwidths of Ukraine and the draft Plan for Use of Radio Frequency Resource of Ukraine according to requirements of the Law “On Radio Frequency Resource of Ukraine”;
   5. development of proposals on the amount of monthly fees for use of radio frequency resource of Ukraine, amounts of fees for issuing, reissuing, extending the period of validity, issuing duplicates of licenses for use of radio frequency resource of Ukraine and submitting the above proposals to the Cabinet of Ministers of Ukraine for approval;
   6. determination of the amount of fees for issuing of operational permit;
   7. setting tariffs for works (services) performed by the Ukrainian State Centre of Radio Frequencies (UCRF);
   8. coordination and control over execution of state supervision over use of radio frequency resource of Ukraine;
   9. control over radio frequency monitoring execution;
   10. setting the procedure for selling, operation of radio electronic facilities and emitters in the territory of Ukraine as well the procedure for their import;
   11. coordination of works on assessment of conformity of radio electronic facilities and emitters produced in Ukraine and imported from abroad;
   12. control over execution of the Plan for Use of Radio Frequency Resource of Ukraine;
   13. ensuring of, with the participation of the Central Executive Authorities in the communications area, carrying out conversion of radio frequency resource of Ukraine within public radio frequency bands;
   14. ensuring of, with the participation of the Central Executive Authorities in the communications area and the Central Command of the Armed Forces of Ukraine, carrying out radio frequency resource of Ukraine conversion within special radio frequency bands;
   15. application of sanctions, including penalties, under the procedures required by legislation;
   16. participation in preparation of draft laws and other legislative and regulatory acts;
   17. submitting proposals to the draft Law of Ukraine “On the State Budget of Ukraine” concerning financing measures on enforcement of international legal protection of Ukraine interests, carrying out of conversion of radio frequency resource of Ukraine, efficient allocation of radio frequency resource of Ukraine, assignment and designation of radio frequencies, ensuring electromagnetic compatibility of radio electronic facilities and radio frequency monitoring system operation;
   18. analysis of observance of laws, other normative acts and regulatory documents relating use of radio frequency resource of Ukraine;
   19. agreement of thematic plans for scientific research and development projects on radio frequencies allocation, assignment and designation, their international legal protection, ensuring electromagnetic compatibility of radio electronic facilities and radio frequency monitoring system operation;
   20. ensuring international coordination and international protection of frequency assignments of Ukraine, participation in the activities of the International Telecommunication Union and other international organizations on issues that relate to the competence of the NCCR, organization of their decisions implementation in accordance with the applicable procedure, participation in elaboration of relevant draft of international agreements of Ukraine;
   21. management and control over performance of the State Inspection of Communications and the Ukrainian Centre of Radio Frequencies.
   22. execution of other powers under the requirements of the Law “On Radio Frequency Resource of Ukraine”.

 

Licensing and Radio Frequencies Department is a structural subdivision of the National Commission for Communications Regulation of Ukraine.

Licensing and Radio Frequencies Department implements the state policy in the area of use of radio frequency resource of Ukraine.

Licensing and Radio Frequencies Department acts in accordance with the Laws of Ukraine “On Telecommunications”, “On Radio Frequencies Resource of Ukraine”, NCCR Decisions, other legislative and regulatory acts and the Provisions on the NCCR.

The Department consists of five divisions:

• Radio Frequency Resource Licensing Division;
• Division of Registration and Licensing of Types of Activity;
• Division of Radio Frequency Resource Conversion and Contests Introductions;
• Division of Planning of Radio Frequency Resource Usage and Radio Electronic Facilities Operation;
• Division of Analysis of Radio Frequency Resource Usage and Electromagnetic Compatibility.
